1. About These Terms
These Terms of Service explain the conditions that apply when you visit the Hapsy website or purchase products from us.
By using our website or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy and Returns & Refunds Policy. Please read them carefully before completing a purchase.
Nothing in these Terms limits or excludes any rights you have under applicable UK consumer law.

Hapsy offers clever home solutions, distinctive décor and practical pet essentials selected for their usefulness, thoughtful design and ability to make everyday life simpler and more enjoyable.
Our online store is hosted using Shopify. However, any contract for the purchase of Hapsy products is between you and Hapsy, not Shopify or any fulfilment, delivery or payment provider we use.
3. Who Can Place an Order
You must be at least 18 years old and legally capable of entering into a binding contract to place an order.
If you are under 18, an order must be placed by a parent, guardian or another adult acting on your behalf.
By placing an order, you confirm that:

You are authorised to use the selected payment method;

You are purchasing for lawful personal or household purposes;

You agree to these Terms and the policies referenced in them.
4. Product Information
We take reasonable care to ensure that product descriptions, specifications, measurements, colours, photographs and prices are accurate.
However:

Colours may appear slightly different depending on your screen;

Handmade, woven or natural-material products may have minor variations;

Measurements may be approximate;
-
Product packaging may differ from that shown;
-
Minor design improvements may be introduced without materially changing the product.
Any variation must not materially affect the product’s main characteristics, quality or intended use.
Please read the complete product description, dimensions, materials, care instructions and safety information before placing an order.
Our products are not intended to diagnose, treat, cure or prevent any medical condition unless expressly stated and legally supported.
5. Product Availability
All orders are subject to product availability.
Placing an item in your basket does not reserve it. If a product becomes unavailable after you place an order, we will contact you and offer:

A full refund for the unavailable product;

An appropriate alternative, but only with your agreement; or
-
Another reasonable solution agreed with you.
We will never substitute a materially different product without your consent.
6. Prices and Taxes
All prices are displayed in pounds sterling and include applicable UK taxes where required.
Standard UK delivery is currently free unless a delivery charge is clearly displayed on the product page or at checkout.
The total amount payable, including any applicable taxes and delivery charges, will be shown before you complete your order.
We may change prices at any time, but changes will not affect orders that have already been accepted.
If an obvious pricing or listing error is identified before an order is accepted, we may contact you to confirm whether you wish to purchase the product at the correct price or cancel the order for a full refund.
7. Payment
We accept the payment methods displayed at checkout, which may include major debit and credit cards, Apple Pay, Google Pay and other secure payment options supported by your device or browser.
Payment is processed through authorised third-party payment providers. Hapsy does not directly store complete payment-card details.
You confirm that you are authorised to use the payment method provided. We may cancel an order where payment is declined, reversed, unauthorised or reasonably suspected to be fraudulent.
We do not charge additional fees solely because you use a particular consumer debit card, credit card or payment method where such fees are prohibited by law.
8. How the Contract Is Formed
After placing an order, you will receive an order confirmation email. This confirms that we have received your order but does not necessarily mean that it has been accepted.
A contract for a product is formed when we send confirmation that the product has been dispatched.
Where an order contains multiple products dispatched separately, a separate contract may be formed for each product when that product is dispatched.
Before dispatch, we may decline or cancel an order for legitimate reasons, including:

The product is unavailable;

Payment cannot be authorised;

There is an obvious pricing or product-description error;
-
We cannot deliver to the address provided;
-
We reasonably suspect fraud or unlawful activity;

The order breaches applicable purchase restrictions.
If we cancel an order after taking payment, we will issue a full refund for the cancelled product.
9. Order Changes and Cancellations Before Dispatch
If you need to change or cancel an order, contact us as soon as possible through live chat or at hapsy.support@gmail.com.
We will make reasonable efforts to accommodate your request, but we cannot guarantee that changes or cancellation will be possible once processing or fulfilment has started.
If an order has already been dispatched, you may still have the right to cancel and return it after delivery as explained in Section 13 and our Returns & Refunds Policy.
10. Delivery Area
We currently deliver to residential and business addresses within the United Kingdom.
Delivery to certain remote locations, including some Scottish Highlands and Islands, Northern Ireland, the Isle of Man and the Channel Islands, may require additional time or may not be available for every product.
We do not normally deliver to PO boxes or British Forces Post Office addresses unless availability is expressly confirmed at checkout.
11. Processing and Delivery Times
Orders are normally processed within 2-5 business days, excluding weekends and UK bank holidays.
Most UK orders are delivered within approximately 7-20 business days from the date the order is placed.
Delivery dates are estimates unless we have expressly agreed a guaranteed date with you. We aim to deliver orders without undue delay and within 30 calendar days, unless a different delivery period has been clearly agreed.
If we cannot deliver within the agreed period, we will contact you with an updated estimate and explain your available options.
Your statutory rights relating to late delivery remain unaffected. Further information is available in our Shipping Policy.
12. Separate Parcels and Fulfilment Locations
We work with several specialist fulfilment locations, some of which may be outside the United Kingdom.
If an order contains multiple products, they may be dispatched separately and arrive in different parcels on different dates. You may receive separate tracking details for each parcel.
By ordering multiple products, you agree that they may be delivered separately, provided that all products are delivered within the agreed delivery period. You will not be charged additional delivery fees solely because we divide an order into multiple parcels.
Regardless of the fulfilment location, your purchase remains with Hapsy, and Hapsy remains responsible for delivery in accordance with these Terms.
UK customers should not normally be required to pay unexpected import duties upon delivery. If a carrier or customs authority requests an additional payment, please contact us before paying so that we can investigate.
13. Your Right to Cancel
For most products purchased online, you have the right to cancel without giving a reason.
You must notify us of your decision to cancel within 14 days beginning on the day after you, or a person nominated by you, receives the goods.
If an order is delivered in several parcels, the cancellation period normally begins on the day after the final parcel is received.
After notifying us, you must return the goods within a further 14 days.
To cancel, contact us through live chat or email hapsy.support@gmail.com and clearly state that you wish to cancel. Please include your name and order number.
Your cancellation right may not apply to certain products where permitted by law, including:

Personalised or custom-made products;
-
Perishable products;
-
Sealed products that are unsuitable for return for health or hygiene reasons once unsealed;

Products inseparably mixed with other goods after delivery;
-
Other products legally exempt from the cancellation right.
These exclusions do not affect your rights where a product is faulty, damaged, incorrect or not as described.
14. Returning Products
You must contact Hapsy before returning any product so that we can provide the correct return address and instructions.
Do not return a product to the address printed on the original parcel. It may be a logistics address that is not authorised to process returns.
Different products may have different authorised return locations. Do not combine products from separate orders or parcels in one return unless we instruct you to do so.
For change-of-mind returns:

You are normally responsible for the direct return postage cost;

We recommend using a tracked service;

You should retain proof of postage;
-
You are responsible for taking reasonable care of the product while it is in your possession.
You may inspect a product as you reasonably would in a shop. We may reduce a refund to reflect loss in value caused by handling beyond what was reasonably necessary to establish the product’s nature, characteristics and functionality.

15. Refunds Following Cancellation
For an eligible cancellation, we will refund:

The price paid for the returned product; and
-
The cost of the least expensive standard delivery option offered, where you paid an outbound delivery charge.
We do not have to refund the additional cost of express, premium or upgraded delivery beyond the cost of standard delivery.
We may withhold the refund until we receive the returned goods or acceptable evidence that they have been sent back, whichever occurs first.
The refund will be processed without undue delay and no later than 14 days after we receive the goods or acceptable evidence of return.
Refunds are issued to the original payment method. Your bank or payment provider may require additional time to display the funds.
16. Faulty, Damaged, Incorrect or Misdescribed Products
Under the Consumer Rights Act 2015, goods must be:

Of satisfactory quality;

Fit for their intended purpose;

As described;

Matched to any model or sample shown, where applicable.
If a product is faulty, damaged, incorrect, incomplete or materially different from its description, contact us as soon as reasonably possible.
Please provide your order number, a description of the issue and, where reasonably requested, photographs or a short video of the product, packaging and shipping label.
Depending on the circumstances and your legal rights, we may provide:

A repair;

A replacement;
-
Replacement parts;
-
A full or partial refund;

Another appropriate remedy agreed with you.
You may have a short-term right to reject faulty or misdescribed goods within 30 days of delivery. After this period, you may have rights to a repair or replacement and, where those remedies are unavailable or unsuccessful, a price reduction or final right to reject.
Hapsy will cover reasonable return costs for products that are faulty, damaged, incorrect or not as described. Please contact us before arranging a return so that the return method and costs can be approved.
Nothing in these Terms limits your statutory rights.
17. Lost, Delayed or Misdelivered Parcels
Hapsy remains responsible for your order until it comes into your physical possession or the possession of a person or location expressly nominated by you.
If a parcel is delayed, lost, delivered to the wrong address or marked as delivered but cannot be located, contact us. We will investigate with the relevant delivery provider.
If a parcel is confirmed as lost, we will offer an appropriate remedy, which may include a replacement at no additional cost or a full refund for the missing product.
You are not required to resolve a lost-delivery claim directly with the carrier, although the carrier may contact you for additional information.
18. Delivery Information Provided by You
You are responsible for checking that your name, delivery address, postcode and contact information are accurate before placing an order.
If you identify an error, contact us immediately. We will try to update the details, but we cannot guarantee that changes will be possible after processing has started.
We are not responsible for delays caused solely by materially incorrect or incomplete information supplied by you. However, we will make reasonable efforts to help recover or redirect the parcel.
We may deduct reasonable additional costs caused by incorrect information only where permitted by law and where those costs were reasonably incurred.
19. Offers, Discount Codes and Promotions
Promotions and discount codes may be subject to additional terms displayed when the offer is made.
Unless otherwise stated:

Discount codes cannot be exchanged for cash;

Only one discount code may be used per order;

Codes must be entered before checkout is completed;
-
Discounts cannot normally be applied retrospectively;
-
Promotions may have an expiry date or eligibility requirements.
Nothing in promotional terms affects your statutory rights, including your rights concerning faulty or misdescribed sale products.
20. Acceptable Use of the Website
You must not use the website:

For unlawful or fraudulent purposes;

To introduce viruses, malicious code or harmful technology;

To interfere with the website’s security or operation;

To gain unauthorised access to accounts, systems or data;

To submit false, abusive, threatening or misleading content;

To infringe another person’s intellectual-property or privacy rights;

To place orders using stolen or unauthorised payment information.
We may restrict access, cancel affected orders or report suspected unlawful activity where reasonably necessary.
21. Intellectual Property
Unless otherwise stated, the Hapsy name, logo, website design, written content, graphics, product photography and other original website materials are owned by or licensed to Hapsy.
You may view and use the website for personal, non-commercial shopping purposes.
You must not reproduce, republish, distribute, modify, scrape or commercially exploit our content without prior written permission, except where permitted by law.
Third-party trademarks and materials remain the property of their respective owners.
22. Reviews and Customer Content
If you submit a review, photograph, comment or other content to Hapsy, you confirm that:

It is honest and based on your genuine experience;

You have the right to submit it;
-
It does not infringe another person’s rights;
-
It is not unlawful, abusive, discriminatory, defamatory or misleading.
You give Hapsy permission to display and reproduce the submitted content for operating and promoting the store. You retain ownership of your original content.
We may remove content that breaches these Terms or applicable law, but we will not remove a genuine negative review solely because it is unfavourable.
23. Third-Party Services and Links
Our website may use or link to third-party services, including payment processors, delivery providers, live-chat services and social-media platforms.
Third-party websites operate under their own terms and privacy policies. We are not responsible for their independent content or practices.
This does not limit Hapsy’s responsibility for your order or for services that we appoint to process payment, fulfil or deliver it.
24. Website Availability
We aim to keep the website accurate, secure and available, but we cannot guarantee uninterrupted access.
We may temporarily suspend or update the website for maintenance, security, technical or operational reasons. This will not affect contracts already formed or your statutory rights concerning existing orders.
25. Our Responsibility to You
We are responsible for losses that are a foreseeable result of our breach of these Terms or failure to use reasonable care and skill.
We are not responsible for losses that were not foreseeable when the contract was formed or for business losses where you purchased products wholly for personal or household use.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:

Death or personal injury caused by negligence;

Fraud or fraudulent misrepresentation;

Breach of your statutory consumer rights;

Defective products where liability cannot legally be excluded;

Any other matter that cannot lawfully be excluded or limited.
26. Events Outside Our Reasonable Control
We are not responsible for delay caused by events outside our reasonable control, such as severe weather, carrier disruption, customs delays, industrial action, natural disasters or failures of essential networks.
If such an event affects your order, we will contact you as soon as reasonably possible and take reasonable steps to minimise the delay.
This section does not remove your rights relating to late or failed delivery. If there is a substantial delay, you may have the right to set an additional reasonable delivery period or cancel the affected order.
27. Privacy and Data Protection
We process personal information in accordance with our Privacy Policy and applicable UK data-protection legislation.
Please review our Privacy Policy to understand what information we collect, why we collect it, how it is used and your rights regarding your personal data.
28. Changes to These Terms
We may update these Terms to reflect changes to our business, website, services or legal obligations.
The version that applies to your purchase is the version available when you place your order. Changes made later will not retrospectively alter an existing contract unless required by law or expressly agreed with you.

29. Severability
If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
An unlawful or unenforceable provision will be treated as removed or limited only to the minimum extent necessary.
30. No Waiver
If we delay enforcing any right under these Terms, that does not mean that we have waived that right.
Any waiver must be clear and applies only to the particular circumstances for which it was given.
31. Governing Law and Courts
These Terms and any contract between you and Hapsy are governed by the laws of Scotland.
If you live in Scotland, you may bring legal proceedings in the Scottish courts.
If you live elsewhere in the United Kingdom, you retain the right to rely on the mandatory consumer laws that apply where you live and may bring proceedings in the courts of that part of the United Kingdom where permitted by law.
